02. ORDERING FROM US
2.1 We consider you to have placed an order when you have used our online checkout process, or you have placed an order with us over the phone, or in person. During the online checkout process, you will be given the opportunity to review your order and correct any errors before proceeding. After the order has been placed, we will email you to acknowledge that we have received and are processing your order.
2.2 After receiving your order, we will review your payment details and our stock availability, and then charge your payment card. All orders are subject to stock availability.
2.3 We may refuse your order at our discretion. If we refuse your order, we will inform you of this as soon as possible. If we have already taken your payment, we will refund it in full to the original payment source within 30 days of receiving your order. We will not be obliged to pay any additional amount as compensation for disappointment. Circumstances where we may refuse your order are:
a) where we cannot obtain authorisation for your payment
b) we do not have the required stock to complete your order
c) we do not deliver to your area
d) there has been a pricing or product description error
e) you do not meet the eligibility criteria set out in our Terms and Conditions
3.1 Our product pricing (especially diamond engagement rings) may change on a frequent basis due to fluctuations in diamond and metal values. Whilst we endeavour to keep all prices on our website accurate, sometimes errors do occur. If such an error has occurred, we will contact you as soon as possible to offer an alternative product and/or price for your order. If we cannot contact you, we will refuse the order.
3.2 Our website also features set pricing for diamond carat weight. Whilst we endeavour to source the exact diamond specifications as described on your order, if we are unable to source the exact diamond we will contact you to offer an alternative diamond and/or price.
4.1 Once we have confirmed your order, we normally take 2-3 weeks to ship a standard order and 3-4 weeks for a bespoke order. We will make every effort to ship your goods within our estimated timescales, however in the event of unforeseen delays, we are under no obligation to ship the goods within these estimated timescales. We are also not liable to pay compensation should we fail to meet an estimated shipping or delivery date.
4.2 We can ship your goods to an address that’s different to your payment billing address. However, as a security precaution we require that this alternative shipping address is registered with your payment card company.
4.3 If you would prefer to collect your goods in person from the Goldsmiths Centre, Hatton Garden, please contact us first to arrange an appointment. We will require you to show proof of identity such as your passport or driving licence.
5.1 Once your goods have been shipped, we will provide you with a tracking number and status updates via email. Delivery will usually be with Royal Mail Special Delivery, and will require a signature upon delivery; otherwise a collection ticket will be left which will give you instructions to collect the goods or organise redelivery. You will need to collect the goods within the time specified on the collection ticket, or they will be sent back to us; in this event, we may charge you for the extra delivery fees. We deem the goods to be delivered when a signature has been received, or it has been collected from the collection centre.
5.2 It is your responsibility to ensure the delivery address you provide to us on the order is secure and not accessible by anyone else. We deem the goods to be delivered when the goods have been signed for or collected from the collection point, and not when delivered to you personally.
5.3 We will notify you by email when your goods have been shipped and provide you with a delivery tracking number. It is your responsibility to monitor the expected delivery date and/or time. If you have not received the goods within the scheduled time, you must notify us within 10 working days of this scheduled time; after 10 working days, we will deem the goods to be successfully delivered, and returns can only be made under the Returns policy outlined in these Terms and Conditions.
5.4 Once your goods are delivered, all risk is passed to you and it is your responsibility to insure and protect your items. We provide guidance on this in our Insurance section on our website.
5.5 If the delivered goods are not what you ordered, not in the right quantity, or are damaged or defective, you must notify us within 10 working days of the delivery date. We will do our utmost to rectify the problem, either by repairing or replacing the item free of charge, or refunding the item in full once you have returned it to us. If you fail to notify us within 10 days of the delivery date, we will not be held liable.
06. LIMITATION OF LIABILITY
6.1 We will not be responsible for:
6.1.1 losses that were not caused by any breach on the part of us; or
6.1.2 any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure); or
6.1.3 any indirect or consequential losses that were not foreseeable to both you and us.
6.1.4 We will not be held responsible for any delay or failure to comply with our obligations under these Terms and Conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your legal right to have goods sent within a reasonable time or to receive a refund if goods ordered cannot be supplied within a reasonable time owing to a cause beyond our reasonable control.
6.1.5 Nothing in these Terms and Conditions limits or excludes our responsibility for fraudulent representations made by us or for death or personal injury caused by our negligence or wilful misconduct.
07. RETURNS, CANCELLATIONS AND REFUNDS.
7.1 We strive to ensure that our customers are delighted with our jewellery, however we understand there may be instances where you would like to return an item for a refund. For returns to be considered, you must contact us first so that we can explain the returns process. We can refund most items up to 14 days after the date of delivery. For promise rings, we will accept returns 90 days beginning from the date of delivery. We do not offer returns on earrings for health and safety reasons. We also don't offer returns on bespoke items or items that have been personalised, for example engraved items. For bespoke items, we can provide computer-generated images of your design to ensure it meets your acceptance before production.
7.2 You must return the item to us in its unworn, as-new condition, including original packaging, diamond certificates, and any other documentation. Diamond certificates are unique items prepared by specialist grading laboratories such as GIA and are expensive to replace. If not returned, the cost of replacing this will be deducted from the refundable amount, at a minimum of £350.
7.3 You must arrange appropriate shipping, and cover shipping and insurance costs to return your item to us. Please contact us so that we can advise on the correct shipping and insurance before returning your items. Sarah Phillips Jewellery will not be responsible for loss or damage of return shipments. We cannot be held liable for any loss or damage you may incur due to late, lost or cancelled delivery, so you must retain all shipping receipts and documentation.
7.4 Once we’ve received your item, we will inspect the condition of the item and any documentation. If we accept the return, we will refund you within 14 days using the original payment method and source when you purchased the items.
8.1 For most engagement rings styles, we offer one free ring size alteration within 6 months of purchase, up or down 3 UK sizes. We will charge a minimum of £40 for any additional resizes after the free resize. Eternity rings, diamond shoulder set rings, and bespoke designs are not able to be resized, however at our discretion we may be able to exchange the item for the correct size, or have the item remade, at an additional cost. Please note the metal weight and/or number of stones featuring in these pieces may change due to resizing.

15. WARRANTY AND MANUFACTURING GUARANTEE
15.1 We believe in producing timeless jewellery, and stand by the quality of our pieces. We will refund or repair items returned to us within 6 months of the purchase date if there is a manufacturing defect.
15.2 We reserve the right not to refund your purchase if the item is damaged, shows wear and tear, has stretched due to incorrect sizing, or that there is evidence of unauthorised repairs or resizing taking place.
Our jewellery is manufactured to a high standard, however normal wear and tear can affect the structure of the ring and claws. It is your responsibility to have your jewellery periodically examined and cleaned to ensure structural integrity of the piece. It is also your responsibility to insure your items against loss or damage.
